This policy explains how Music Merch Marketplace LLC (“Music Merch Marketplace”, “we”, “us”) handles personal information when you use musicmerchmarketplace.com (also reachable at merch.forsale) and related services. It is part of our Terms of Service.
1. Information we collect
- Account information. Your email address and password (stored hashed), or, if you sign in with Google, the name, email address, and profile picture Google shares with us. Anything you add to your profile, such as a username, display name, avatar, or bio.
- Content you provide. Photos and details you add to your collection or want lists, photos you submit for appraisal, and optional answers you give us, such as how you heard about us.
- Music listening, if you connect Spotify. If you connect Spotify or sign in with it, the artists you listen to most and the artists you follow there, and your Spotify display name and picture. We use them to suggest artists to follow. Disconnecting deletes them; the artists you chose to follow stay until you unfollow them.
- Location, if you choose. A city or region you type in or share through your browser’s location prompt. You can clear it at any time.
- Usage and device information. Pages you view, features you use, links you click, and technical data such as IP address, browser type, and device information, collected through cookies and similar technologies and our servers’ logs.
- Communications. Messages you send us, including feedback and support requests.
2. How we use it
- to provide the Service, including your account, collection, appraisals, and nearby events;
- to operate, maintain, and improve the Service and our catalog;
- to understand how the Service is used and fix problems;
- to communicate with you about your account and the Service;
- to recommend merch and notify you about artists you follow and items on your want list;
- to run giveaways and promotions you choose to enter;
- to keep the Service secure, prevent abuse, enforce our Terms, and comply with the law.
3. Appraisal photos
When you submit a photo to Appraise, it is processed by a third-party AI service provider to identify the item and estimate its value. We do not store appraisal photos, we do not send your name or email with them, and our providers may not use them to train their models.
4. How we share it
We do not sell your personal information or share it for targeted advertising. We share it only:
- With service providers who process it on our behalf, under contract, for hosting, data storage, authentication, analytics, AI processing, location lookup, and email;
- With Google, if you choose to sign in with your Google account;
- With Spotify, if you choose to connect or sign in with your Spotify account;
- When required by law, or to protect the rights, property, or safety of our users, the public, or us;
- In a business transfer, such as a merger or sale of assets, in which case this policy continues to apply.
Links to marketplaces, stores, and ticket sellers take you to sites we do not control. Their own privacy policies apply once you leave, and some links are affiliate links (see our Affiliate Disclosure).
5. Cookies
We use cookies and similar technologies to keep you signed in, remember your preferences, and measure how the Service is used. We do not use advertising cookies. You can block or delete cookies in your browser, though some features may stop working.
6. What is public
Your profile name and avatar may appear alongside things you post. Collection items are public by default, and you can mark any item private. Photos you upload to your collection or want lists are stored at web addresses that anyone with the link can open, even when the item is private, so do not upload photos showing people, documents, addresses, or anything else you would not want seen. Photos and item details you submit may also help improve our public catalog without identifying you, as described in the Terms of Service. Your private notes and purchase prices are never part of that.
7. Retention
We keep your information for as long as your account is active and as needed to provide the Service, meet legal obligations, resolve disputes, and enforce our agreements. When you delete your account, we delete or anonymize your personal information, except where we must keep it by law. Information that no longer identifies you may be retained.
8. Your choices and rights
- You can view and update your profile, location, and collection, and make items private, at any time.
- You can stop our weekly email from the unsubscribe link in any email or from your account settings.
- You can delete your account from your account settings.
- You can decline optional questions and the browser location prompt.
- Depending on where you live, including California, the European Economic Area, and the United Kingdom, you may have the right to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to complain to a data protection authority. We will not discriminate against you for exercising these rights.
To make a request, email support@musicmerchmarketplace.com. We may need to verify your identity before we respond, and we will respond within the time the law requires.
9. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has given us information, contact us and we will delete it.
10. Security
We use reasonable technical and organizational measures to protect your information, including encrypted connections and hashed passwords. No system is perfectly secure, so please use a strong, unique password.
11. International users
We are based in the United States. If you use the Service from elsewhere, your information will be transferred to and processed in the United States and other countries where our service providers operate, which may have different privacy laws than where you live.
12. Changes to this policy
We may update this policy from time to time. The effective date at the top shows when it last changed, and we will notify you on the Service or by email before material changes take effect.
